The mother of a Regina woman who fell 10 floors to her death down a hotel laundry chute is filing a lawsuit against the Delta Hotel chain.
On Monday, Regina lawyer Tony Merchant filed a statement of claim on behalf of Laura Apooch against Delta Hotels and Resorts and Luxury Hotels International.
Apooch is the mother of Nadine Machiskinic, who died on Jan. 10, 2015, after plunging down a laundry chute at the Delta Hotel. She was found just after 4 a.m. and died from her injuries in the hospital two hours later.
The statement of claim contains allegations that are not proven in court. The statement of claim alleges the Delta Hotel was negligent in the design, maintenance and security monitoring around the laundry chute which poses a danger to the public.
A representative for the hotel chain said Delta won’t be commenting on the lawsuit at this time.
Family calls for answers
Machiskinic was 29 when she died. She left behind four children who are now 14, 11, four and 18 months old. On Sunday afternoon, her family held a vigil to mark the one year anniversary of her death and to shine light on her case.
Delores Stevenson is Machiskinic’s aunt. A year after her niece’s death, she says the family is still waiting to see a coroner’s report.
“It’s been frustrating not having answers and continually waiting on the results,” Stevenson said in an interview Monday. “It’s been pretty frustrating, and the time frame that it’s taking to complete the toxicology and coroner’s report.”
Police ruled out foul play in Machiskinic’s death, but her family wants to know more about the circumstances.
“Police investigators gave us the scenario of an intoxicated woman who possibly wandered into the Delta Hotel and went up to the tenth floor and possibly put herself in the laundry chute, which makes no sense at all,” Stevenson said.
Stevenson wants to know what the toxicology report says about her level of impairment.
“By what was in her system or the toxicology reports, I’m pretty sure that will have a lot to say about what possibly happened that night and her judgment,” she said.
Stevenson says there are still a lot of unanswered questions about what happened to her niece the night she died.
