Once again the future of Capital Pointe will be argued in front of an appeal Board Friday.
The Saskatchewan Building and Accessibility Standards Appeal Board will re-hear a limited portion of an appeal relating to the future of the Capital Pointe site.
Last summer the appeal board cancelled the city’s order to backfill the hole and gave control to Westgate Properties, the Capital Pointe developer. The appeal board gave the developer three options: finish the project with a deadline to start construction as of April 1, 2019, construct permanent shoring on the site to keep it safe or decommission and backfill the hole.
Last November, a Court of Queen’s Bench judge found most of the appeal board’s decision reasonable but ordered a re-hearing of the issue of the content in the conditions given.
The judge said there was no chance for either party to argue the merits or if a variation order was feasible.
The hearing is only expected to last a day.
