Premier Scott Moe is “disappointed” the Ontario Court of Appeal ruled Friday that the federal government’s carbon pricing scheme is constitutionally sound.
“We commend the Government of Ontario for their representation of the people of their province. With two split decisions, there is a strong legal argument that this tax is unconstitutional,” Moe said in an emailed statement.
In May, Saskatchewan’s Court of Appeal denied the provincial government’s challenge on the Liberal government’s carbon tax. The judges voted 3-2 to reject the Sask. Party’s argument that the feds didn’t have the constitutional power to collect the carbon tax in Saskatchewan starting April 1.
The Saskatchewan government is set to take the carbon tax fight to the Supreme Court of Canada on Dec. 5.
However, before Canada’s highest court hears these arguments, Moe said Canadians “have an opportunity to decide the fate of the damaging and ineffective Trudeau carbon tax during the federal election this October.”
