Scheduling conflicts delay Fahlman preliminary hearing dates

Chris Fahlman, 42, briefly appeared by video in provincial court as counsel continued working to secure dates for a multi‑day preliminary inquiry.

Fahlman is charged with second-degree murder and intentionally discharging a firearm while being reckless to the life or safety of another person, connected to the fatal shooting of Weyburn’s Tanya Myers on Highway 39 in September.

During Monday’s appearance, defence counsel Sharon Fox and the court reviewed several potential time blocks for the preliminary hearing. The judicial assistant previously offered three options: July 2 to 10, July 27 to Aug. 5 and Aug. 10 to 18. Fox confirmed she is available for the July dates, while earlier correspondence showed the Crown had only confirmed availability for August 10 to 18.

However, the Crown had not indicated whether the July dates were still possible, leaving counsel unable to secure a mutually-available block. The judge noted that without clear confirmation from Crown prosecutor Bélanger, the court cannot reserve multiple consecutive days for the hearing.

Because the matter is technically a Weyburn matter, Fox suggested returning the case to the Weyburn docket for the next appearance. The judge agreed.

The matter has now been adjourned to Jan. 6 at 9:30 a.m. in Weyburn, via CCTV, where the only purpose will be to finalize preliminary inquiry dates. If the July windows do not work for the Crown, the court will need to return to “the drawing board” and seek additional multi‑day options.

Fahlman remains in custody.
